Buning Man and copright protected material
A company that does pins, stickers, postcards and other things just refused to print a pin with a pic of last years man and the words, "Burning Man 2011". They have been printing this type of thing for some time. No problem. Now they say it is copyright protected. I thought we could use the name and pics for our personal use, just not as a for sale product. I have given and received many pieces of schwag, some homemade, some produced, with the symbol and the words Burning Man. It's rampant.
So what's the deal? Can we use this stuff for our own, non commercial use, or does Burning Man, like Disney, protect these things?

We can use them for our own, non-commercial uses.
I'd dig around on the main site to figure out exactly what that means. Or email/phone them.
That being said, you cannot force a company to print something they do not want to print. If they've changed the policy, they've changed it. I'd show them the webpage where it says that we can use it, but if that's not enough for them, then that's that.
What they go after absolutely is "Burningman" in the title of ebay items, or any gear or other good sold as "Burningman." If you say, for instance "Desert Camo" in the title and in the description "good for burning man" then you should be alright. But don't name it "Burningman Camo."
If the llc has changed their policy, it is to be hoped that they would inform us. (I wish I could believe that was a given, but whatever.) On playa, those items with the man on them have a lot of value as schwag, and I hope that the llc understands and supports that.

You guys are right. It's just that I've been using them for lots of different products and they do a good, if a bit pricey, job. I just sent them the photographers agreement. That's the last thing. Anyone know a good pin maker?

This is one from last year. It says Black Rock City, but I gifted the ones that said Burning Man 2010. I know, it's 2009's Man.

Chances are, especially in this economy, you will find another shop that does better work for less money. Which will be a good thing, no?

If you go to
http://www.cieux.com/bm/2dTime.html
and search the page for pins you'll find a list of companies I've used. I'm currently using Dr. Don's Buttons, and he has printed whatever lapel pins and stickers I've asked for.
Our pin from this year:

The sticker we handed out:

Both from Dr. Don.

Anyone have a line on a good patch maker?
And I can understand why Teardropper doesn't want to just walk away from what has been a good relationship. There's a level of trust that isn't reached right away. I wish I had a good way to talk to the shop to explain that that is not an issue.

I think it's not copyright, I think it's trademark.
I don't know what parts of the name or logo of the Man are trademarked or if they are. I recall in John Law's lawsuit, he claimed BMOrg wasn't protecting its trademarks, so I'll guess there are some, but I don't see the R-in-a-circle on this board.
This has information I'm not willing to read through:

Go to the bottom re: gifts and you'll find the permission for use, if that's permission.

what if i put the official logo in the form of a tattoo on my schvantz?
besides not getting into heaven, will i get sued?
what if i need to pull some tricks if i go on a sheener and end up naked in a dumpster in fresno with no wallet and no idea how i got there?
are there any precedents?
In other words, participants can use it to make stuff to give away, but no-one but the LLC can use it for stuff to sell.

Only in the court of public opinion. Do we really need to see anything else with the trademarked stick figure on it?Simon of the Playa wrote:what if i put the official logo in the form of a tattoo on my schvantz?

I'm pretty sure the back of the ticket says IT'S A FUCKING ART FESTIVAL, DO SOMETHING FUCKING ORIGINAL.
If not, you have my permission to use that for a button.

I'm still a little confused by that. Are we sure it's not Booning Man? At least I can see a verb "to boon." "To Bune" doesn't quite cut it. Which is why I thought it might be "Bunningman". I don't know how one "buns" but I do know that any noun can be verbed. Maybe "bunning" is something you do at assembly line barbeques.Simon of the Playa wrote:not to get off topic, but what are the rules for "Buning Man"?
Or maybe it's something billion bunnies do to insure that there are a billion bunnies.
More research is called for.
