There is a notice on the original site that the work is copyrighted, and that it cannot be used without the author's permission. The copyright notice is tattooed on each original photo.
we're not gonna spend $1000 talking to a lawyer, but maybe the BMORG will do something, since they have a copyright on all the photos taken at BM and they don't want them to be sold as "stock" images.
The site plainly states:
Copyright notice
Shutterfly is committed to protecting photographers’ copyrights. Each image submitter is required by US law to own the right to or to obtain permission to use any image before the image is uploaded or printed at Shutterfly. If you believe that your work has been copied in a way that infringes your copyrights, please contact us at the following address and provide all relevant details.
If you know for a fact that Shutterfly is making a profit off your pictures you should seek a laywer that will work probono or at least one that will listen free of charge. Threre are some good ones out there that will do it.
In San Francisco there is an organization downtown that takes cases once
the Legal assastant, ( cant remember the name of these guys. ) makes sure there may be some kind of case. I'm sure there is a place where you are that does the same type of thing.

I wont be able to do it anyway today because my friend is on his way into town to visit me (AGAIN....WOO HOO.) today, so I'll be doing nothing else but partying.
I'm sure you can find out something. From a laywer that wont cost you anything.

It should be determined by a Lawyer if it's not worth the battle. Depending on how much damage and suffering the owner of the site has caused to Tristan and Tristan's reputation, the Lawyer may feel that the owner should loose the site and the domain can be sold for whatever the damages are.
You need a lawyer to determine that.

By the way, it appears that it is Shutterfly which removed the copyright notices automatically, when they crop the uploaded images to match the 4x6 aspect ratio. So this was probably not done purposely. Nonetheless, this is a problem, and ShutterFly should show the entire images, or at least offer an option to see that.

2) I also was nice about your problem by giving you positive support in a way that you could actually do something about it. not only that but if you really read with an open mind what I posted, I actually was agreeing with you and posted the disclaimer (which seems no one else had the sense to do in the first place. ) to back your claim of disaprovement of what the site (shutterfly.) was doing.
