In my opinion, and here, this is just an opinion, it is difficult for denizens of the eplaya to confuse an avatar with an original work, although the artist whose material was appropriated might take issue with this. I am not sure there is a "rule."

The concept of "fair use" underwhich copyrighted material may be reproduced without the author's permission basicallly alllows the right of commentary, parody, artistic re-interpretation, and so on. Without the protection this doctorine affords, free speech rights would be limited.

Passing off someone else's work as your own is not okay. Whether an avatar is understood to be original work or not is a judgement call. While the creators of the image the 4WotA are using as their avatar might object, there seems nothing wrong with its use in this clearly satirical context. If they put the image on a box of breakfast cereal, then they'd have problems.

I getcha... I feel that credit is due where credit is due too. But if he is a bartender and he knows this stuff off the top of his head... well, that's kind of like paid training!

The spooky head was a mask I wore at BM on Friday night. It was kind of GIANT if you know what I mean. I was like 8' with it on. Kept running into stuff trying to get into tents and stuff, but it was fun. It was supposed to be the Baron Samedi, but everyone thought I was Jack Skully so I went with it. =)

I don't think many people thought you were the inventor of all the alcoholic concoctions you posted or collected the recipes from traveling the world one bar at a time. But just think what it would be like if you had, you couldn't even go into a restaurant without some bartender dumping some crap together and trying to get you to drink it. you'd be hounded by people wanting you to record and credit their subtle variations. It could get to be a real drag......

So I'll take a Port Asbestos bloody marry that would have a splash of Canadian beer and instead of a celery sprig it has a strip of moose jerky.

oh there is a box of 4 Women of the Apocalypse breakfast cereal on the shelf over there, EXTRA CRUNCHY have some it repels milk but soaks up beer pretty good.
