TL;DR: Supreme court rules constitutional protections against unreasonable search and seizure prevent police from extending an otherwise completed traffic stop to allow for a drug-sniffing dog to arrive

That reminds me. At the Newbie Orientation last Saturday I had an interesting conversation. I wish I could remember which dept I was talking to. They swore that there would be NO sniffy dogs or undercover officers this year. NONE. I questioned and prodded but couldn't get a source. That would be different.

Sorry. For me its like VUJA DE, "the feeling of never have being here before" as a burgin ;)

Just because it's illegal to make you wait for a dog doesn't mean they wont do it anyway. Cops routinely break the law. There is nothing you can do about it at the time. The cops don't care it the case gets thrown out of court because of it. You cannot argue legalities with the cop.

You absolutely can and should argue legalities with any LEO you find yourself in a situation with. especially a situation where they are trying to ruin your day/burn/life and even more so if they are breaking the law. Cops are fully aware when they are doing it and they are banking on the fact that you aren't aware of the laws and your rights.

The conversation goes like this:

Cop: you don't mind if I take a look around your car do you?
You: I do mind. I know my rights, I value my privacy and I do not consent to a search.
Cop: Ok, I'm gonna call a K-9 unit to sniff your car if you won't consent. Wait here until the dog gets here.
You: am I being detained officer and if so what's the reason? Am I free to go?

At this point the cop either says 'you're free to go' or 'you have to wait' if they say you have to wait you say 'officer I am aware of the laws and I know my rights and it is illegal for you to detain me without a lawful reason. Am I free to go or should I call my lawyer?'

The cop may still choose to break the law and detain you while you with for the dog but usually once Its clear to the cop that you know the laws and your rights they realize that you aren't worth their time.

Or you're a person of color and they shoot you in the back.
