What is the consensus on how the BLM will respond now that the legal recreational system in Nevada is up and running? Will they still have their cannabis alerting dogs, and will such an alert be probable cause to search the entire vehicle? Will they still bust people when they find them in possession of a single joint on federal land? It will be interesting to see how this works itself out.

But haven't most or all of the citations handed out in the past been for violation of the state law? I do not recall any stories of any burner ending up in federal court charged with a federal crime. All the stories I recall are of burners going to the local county court to pay a state fine. Even when the ticket came from the BLM, I think they were handing out state citations, which would no longer be applicable. I would think that the federal courts not want to mess with individual burner possession charges. They have bigger things to do. Here is one possible answer to my original post. They will go after only drivers, but will test for micro levels of THC in urine samples, and then issue a Nevada state DUI charge.

These federal drug testing and enforcement policies/restrictions have been exactly the same for years. Here's the document for 2013 with the exact same wording in the relevant sections as the 2017 document linked in that article.
Nothing has changed. This is a federal policy and law, and pot is not legal at the federal level. Nevada marijuana law has no more jurisdiction over federal law than does Oregon's. Did CN blather on about "peeing in a cup" and "ridiculously low THC thresholds" for the past 4+ years of this same policy?

I do not think this is correct. In the past, I believe it has always been simple Nevada state and county court citations handed out for marijuana possession. I have never heard of anyone from BM having to go to federal court with a federal charge for marijuana possession. ( but I do not presume to have heard everything). This year, Leo's will not be able to hand out Nevada state citations for possession of marijuana, and I do not think they are interested in filling up the federal court system with burners.BBadger wrote:.Nothing has changed. The BLM is certainly interested in filling up their courts system with burners, otherwise they wouldn't be sending so many BLM officers to the playa to issue citations. It's probably a great money maker.
The BLM officers are not simply dropping you off at the local sheriff's office. Federal land and resource management agencies can issue their own federal citations, which are processed through the Central Violations Bureau. Anecdotal reports suggest a misdemeanor charge and fine on the order of $525 per citation, which many simply pay without going to court in person.
