Under the Presidential Records Act, the White House must maintain all documents touched by the president to be preserved by the National Archives and Records Administration.

The former president’s reportedly relentless habit of destroying sensitive documents was clearly in violation of the law.

Trump Organization’s accountants cut ties, calling years of filings unreliable

• In a letter to the Trump Organization dated 9 February, William Kelly, US general counsel of the accountancy firm Mazars, said Trump’s financial statements for the period 30 June 2011 to 30 June 2020 “should no longer be replied upon and you should inform any recipients thereof who are currently relying upon one or more of those documents that those documents should not be relied upon”.
• Last month James’s office told a court that its investigators had uncovered evidence that Trump’s company used “fraudulent or misleading” asset valuations to get loans and tax benefits. Using statements from Mazars, the New York attorney general’s office claimed, among other issues, that the company had misreported the size of Trump’s Manhattan penthouse, saying it was almost 30,000 sq ft, nearly three times its actual size, and inflated the value of Trump golf clubs in Westchester county, New York, and Scotland.
• In 2019, Michael Cohen, Trump’s former personal attorney and an ex-vice-president of the Trump Organization, told Congress that Trump regularly falsified his assets.

^It will be interesting what the Trump SCOTUS has to say. It will also be interesting if any other parties weigh in for blocking testimony. Oddly Roberts has been the swing vote of late. Generally each side's lawyers make their often polar arguments in the form of reams of briefs citing law and cases. Then the court decides whatever it wants and pulls out quotes from the winning side's briefs to justify it. They may go beyond that with their smart clerks and write a longer decision.

New York’s attorney general on Wednesday pounced on former President Donald Trump’s defense of company’s financial statements, saying the five-page statement Trump issued a day earlier contradicted a court filing by his attorneys.

“It is not unusual for parties to a legal proceeding to disagree about the facts,” the attorney general’s office wrote in a letter filed in New York state court. “But it is truly rare for a party to publicly disagree with statements submitted by his own attorneys in a signed pleading -- let alone one day after the pleading was filed.”

Trump’s attorneys repeatedly stated that he did not know enough to respond to allegations of inaccurate valuations. But the former president’s five-page statement got into detail about possible discrepancies, implying that he had more knowledge than his lawyers said.

The order is the latest example of growing legal peril for the former president. Just hours earlier, the National Archives said records found at Trump’s Mar-a-Lago resort contained classified information and that it had notified the Justice Department.
