I do not think a law suit would fly. Scenario:
Employer does not want to spend his own time screening applicants. So an agency is found who, for a small fee, will find suitable applicant that meets requirements given by employer. Employer also requires that applicants hired must pass a drug screen that is to be provided by the agency. The agency contracts with a local medical facility to get drug screens done at a discount rate. Then passes the charge on to the applicant along with a hefty fee for services rendered. (providing a place for you to get a drug screen done without having to set an appointment). Since all employers now require a drug screen for new employees they are garranteed getting the service fee.
Kind of sucks but what can you do?
I'll tell you what you can do! Tell the universe/cosmos that you want this job, be grateful that the right job is already there waiting for you, think positive and smile. Soon the job will come to you.

But the employer did pay for it. It was included in the fee the employer paid to the agency.

Actually, the origin of matza ball soup comes from the bible story where King David unmanned and slew the fierce warrior G'Nad Testicocolus, of the nation of Matza.
