JERUSALEM (AP) — An Israeli rights group plans to use a database detailing the complicity of Israel's government in widespread illegal construction in West Bank settlements to help Palestinians file lawsuits over their lost land, the group said Friday.

The classified database, compiled by Israel's Defense Ministry and leaked to the Yesh Din group, shows that government agencies and private companies building settlements in the West Bank widely ignored Israeli law, in many cases seizing land that belongs to Palestinians. It also demonstrates that the government has long been aware of the lawbreaking and has kept it secret.

The Defense Ministry would not comment on the report.

The internationally backed "road map" peace plan, the basis for Israeli-Palestinian negotiations, calls on Israel to halt all settlement activity. The settlements render the Palestinian goal of establishing a state that includes the West Bank all but impossible, and Israel will have to evacuate all or many of them as part of any peace agreement.

More than 30 settlements were built in part on land owned by Palestinians, the report shows, and in three out of every four settlements some construction was conducted without proper permits.

In one settlement, Elon Moreh, the report says, 18 houses were built on private land. In another, Efrat, a park and a synagogue were built on private land, and in a third, Ariel, a college was built without legal approval. In other settlements, roads, cell phone antennas, basketball courts and neighborhoods were built illegally.

The report focuses on the some 120 West Bank settlements officially authorized by the government since Israel captured the territory in the 1967 Mideast war. In addition, settlers have thrown up some 100 unauthorized settlement outposts, which violate Israeli law but were typically built with the tacit approval or active cooperation of the government.

Michael Sfard, Yesh Din's legal counsel, called the information a "severe indictment" of Israel's military and government. Israeli authorities are "systematically violating international law and the property rights of Palestinian residents," Sfard said in a statement.

The group said it intends to use "all legal means" to challenge the violations listed in the leaked database, including filing civil suits and appealing to Israel's Supreme Court. Yesh Din will begin running ads in Palestinian newspapers to encourage people to take legal action, and will also offer legal counsel, the statement from the group said.

Mandelblit claimed that these there had been exchanges of fire between IDF forces and Palestinians when these persons died, and that there was no proof that these Palestinians were murdered by the IDF.


- On November 8, 2006, an IDF shell hit two buildings in the town of Beit Hanoun, killing 21 Palestinian civilians and injuring additional hundreds. As a result of this crime, the former Chief of Staff, Lt. Gen. Dan Halutz was appointed to lead a committee to investigate the circumstances of the incident.
In this case, Mandelblit decided that no legal action would be taken against any military official regarding this incident, and that the behavior of the IDF personnel involved in the incident was not substantially or severely negligent in a manner that would justify taking legal actions against them. He claimed that "there was no need to open a Military Police investigation into the matter".


- On 26 February 2006, Mandelblit advised Brigadier-General Aviv Kochavi, the commander of the Gaza Division of the IDF, to cancel his studies and stay in England, fearing he would be arrested and tried for alleged war crimes in the Palestinian territories.
Kochavi served as commander of the Paratroops in Gaza and took part during the "Operation Defense Shield" against defenseless civilians in Gaza in 2002, during which over 125 Palestinians were killed, hundreds were gravely injured, and during which the IDF destroyed massive amounts of private and public property in all of Gaza. As such, Kochavi is culpable of crimes of war, crimes against humanity and crimes comprising genocide against the Palestinian people.
That Mandelblit would advise Kochavi in order to help him evade prosecution for his crimes is evidence that Mandelblit is very well aware of the fact that the actions of the IDF are grave crimes.


- On December 24th, 2007 Mandelblit declared that the use of cluster bombs in the Second Lebanon War in 2006 was legal and that Israel would not prosecute IDF personnel over the use of cluster bombs in Lebanon. The use of cluster bombs is almost universally considered as a crime of war, and certainly so in internaitonal treaties of which Israel is signatory.
The IDF used three main types of cluster munitions in that war: those dropped through air force bombs; and other cluster bombs fired through artillery and and in rockets fired from Multiple Launch Rocket Systems. Cluster bombs were used to target fields near populated areas.

The UN says that about four million cluster bomblets were dropped on Lebanon during the 34-day conflict. Many of them failed to explode on impact, posing a danger to civilians in their homes, gardens and fields. More than 30 people have been reported killed by cluster bombs and land mines dropped by the IDF since the 2006 war.

which left one million and half without electricity, gas, and consequentially without the basic needs for the daily life, such as water services.

During this month The Air Force repeatedly attacked the civilian population of Gaza. Hundreds were killed or injured. Among them were seven women and 39 killed children, 89 injured children, and 315 gravely injured. Some of the victims of the IDF from March 2008 are:

Polish police said they have three theories on what happened to the stolen Arbeit macht frei sign above the entrance to the Nazi German concentration camp Auschwitz-Birkenau in what now is southern Poland–but they’re not sharing them for the time being. All they’re saying is the sign wasn’t stolen to be sold as scrap.

I’ll share my theory–the sign may have been ordered by a crazy collector and now Arbeit macht frei decorates someone’s backyard.

Poland had a replica made several years ago that was used during the renovation of the original sign that is now missing, so visitors won’t see any difference.

But this theft shows there’s an urgent need of investment in the Auschwitz museum, including its security. Just three days ago Germany promised 60 million euro to finance the camp, but the total needs are estimated at 120 million euro.

LA Times Op-Ed Calls For Dismantlement of Jewish State

In the past, the Los Angeles Times marked Israel's birthday with an Op-Ed calling for its dismantlement via the so-called "one-state solution." The paper didn't bother to wait for the spring anniversary of the Jewish state's founding, presenting its readers yesterday with another call for a "one-state solution." Jonathan Kuttab's Dec. 20, 2009 Op-Ed ("Steps to Create Israel-Palestine"), like earlier pieces by Saree Makdisi (here and here) and Tony Judt which called for the destruction of the Jewish state, rests on a number of basic factual errors and faulty assumptions.

From the Mediterranean to the Jordan River
Kuttab, a Palestinian attorney and activist, begins by fabricating: "With Israel in total control of the territory from the Mediterranean to the Jordan River and unwilling to relinquish a significant part of the land . . . "

In fact, between the Mediterranean and the Jordan River lies the Gaza Strip which is fully under the control of Hamas—not Israel. Moreover, 40 percent of the West Bank is under the control of the Palestinian Authority. As for Israel's alleged "unwillingness to relinquish a significant part of the land," last week Ha'aretz published a detailed report and a map showing Ehud Olmert's unprecedented offer to Mahmoud Abbas.

Former prime minister Ehud Olmert proposed giving the Palestinians land from communities bordering the Gaza Strip and from the Judean Desert nature reserve in exchange for settlement blocs in the West Bank.

According to the map proposed by Olmert, which is being made public here for the first time, the future border between Israel and the Gaza Strip would be adjacent to kibbutzim and moshavim such as Be'eri, Kissufim and Nir Oz, whose fields would be given to the Palestinians.

Olmert also proposed giving land to a future Palestinian state in the Beit She'an Valley near Kibbutz Tirat Tzvi; in the Judean Hills near Nataf and Mevo Betar; and in the area of Lachish and of the Yatir Forest. Together, the areas would have involved the transfer of 327 square kilometers of territory from within the Green Line.

Olmert presented his map to Palestinian Authority President Mahmoud Abbas in September of last year. Abbas did not respond, and negotiations ended. In an interview with Haaretz on Tuesday, Abbas said Olmert had presented several drafts of his map.

The version being disclosed Thursday in Haaretz is based on sources who received detailed information about Olmert's proposals.

Olmert wanted to annex 6.3 percent of the West Bank to Israel, areas that are home to 75 percent of the Jewish population of the territories. His proposal would have also involved evacuation of dozens of settlements in the Jordan Valley, in the eastern Samarian hills and in the Hebron region. In return for the annexation to Israel of Ma'aleh Adumim, the Gush Etzion bloc of settlements, Ariel, Beit Aryeh and settlements adjacent to Jerusalem, Olmert proposed the transfer of territory to the Palestinians equivalent to 5.8 percent of the area of the West Bank as well as a safe-passage route from Hebron to the Gaza Strip via a highway that would remain part of the sovereign territory of Israel but where there would be no Israeli presence.





The yellow represents the proposed Palestinian territory — 100 percent of the Gaza Strip and 93.7 percent of the West Bank. The orange represents 327 square kilometers (equivalent to 5.8 percent of the West Bank) within Israel's pre-1967 boundaries that Israel would swap in order to annex the 6.3 percent of the West Bank in which its citizens are mostly concentrated — a near 1-to-1 exchange. Blue represents the 6.3 percent of the West Bank that Olmert hoped to annex. Mahmoud Abbas, for his part, has never made any sort of offer or presented any kind of map, so we'd have to agree with Kuttab that the creation of a sovereign Palestinian state on the West Bank and the Gaza Strip looks "less and less likely." But not for the reasons he says.

Kuttab offers two false options for future scenarios, writing:

And although Jewish Israelis may control it now, birthrates suggest that, sooner or later, Jews will again be a minority in the territory.

What happens at that point is unclear, but unless continued military occupation and all-out apartheid is the desired path, now may be the time for Israelis to start putting in place the kinds of legal and constitutional safeguards that will protect all minorities, now and in the future, in a single democratic state of Israel-Palestine. This is both the right thing and the smart thing to do.

Given that the overwhelming majority of Palestinian population centers are under Palestinian control (either Hamas in the Gaza Strip, or the Palestinian Authority in the West Bank), there is no reason why future choices would either be military occupation or "all-out apartheid." The majority of Palestinians currently live under their own governments. How would that status be endangered if more Palestinians than Israelis inhabit the area between the Jordan River and the Mediterranean, as Kuttab hypothesizes? Kuttab does not explain how he makes that leap.

Moreover, Kuttab's rosy depiction of a protected Jewish minority living under a system of safeguards in a binational Israel-Palestinian would be laughable were it not so dangerous. He writes:

At the root of [Israelis'] fear was the belief that despite Israel's best efforts to push Palestinians from land and property and to import Jewish settlers in their stead, the Arab population would keep climbing. And that, when the Arabs reached the 51% mark, the state of Israel would collapse, its Jewish character would disappear and its population would dwindle into obscurity.

Yet that scenario is not necessarily the inevitable result of either demography or democracy. Religious and ethnic minorities have successfully thrived in many countries and managed to retain their distinctive culture and identity, and succeeded in being effective and sometimes even dominant influences in those countries. Those who believe in coexistence must begin to seriously think of the legal and constitutional mechanisms needed to safeguard the rights of a Jewish minority in Israel-Palestine.

It is true that the experience of Israel with its Palestinian minority does not offer a comforting prospect. The behavior of the Jewish majority toward the Palestinian citizens of Israel has not been magnanimous or tolerant. Where ethnic cleansing was insufficient, military rule, land confiscation and systemic discrimination have all been employed.

First, since we are talking about minority rights in the Middle East under an Arab/Islamic majority, can Kuttab point to even one Arab or Muslim country in the Middle East where minorities thrive? (The thriving of religious and ethnic minorities in "many countries," such as the United States, Canada, or Germany, is hardly germaine to this discussion.) More to the point is the treatment of minorities in Arab and Islamic countries, the subject of a recent conference hosted by One Free World International last week. The Jerusalem Post reported:

Every three minutes a Christian is being tortured in the Muslim world, and in 2009 more than 165,000 Christians will have been killed because of their faith, most of them in Muslim countries, according to a human rights organization that is visiting Israel starting Sunday.

"Hamas digs up the bodies of Christians from Christian burial sites in the Gaza Strip claiming that they pollute the earth," said Reverend Majed El Shafie, President of One Free World International (OFWI), who will head a delegation of human rights activists, members of parliament from Canada and religious personalities.

During their visit to Israel the delegation will hold a conference on human rights and persecuted minorities at the Van Leer Institute in Jerusalem. The conference will provide new statistics on the persecution of minorities in Muslim countries.

El Shafie said that between 200-300 million Christians are being persecuted in the world, 80 percent of whom lived in Muslim countries and the rest in communist and other countries. . . .

In the Palestinian Authority controlled West Bank, the situation is also bleak for the dwindling Christian population which is subject to land theft by Muslims, intimidation, job discrimination, forced "protection" monetary payments, and sexual harrasment. But there is persuasive evidence to suggest that Jews living in a Muslim-controlled "Israel-Palestine" would have greater concerns than discrimination and a dwindling population due to lower birth rates. The Hamas charter, for example, proclaims: "The hour of judgment shall not come until the Muslims fight the Jews and kill them, so that the Jews hide behind trees and stones, and each tree and stone will say: 'Oh Muslim, oh servant of Allah, there is a Jew behind me, come and kill him." And the organization, which rules the Gaza Strip and which is designated as a terrorist organization by the United States, does not simply bury that message in its official documents. Rather, it actively inculcates its youngsters with this genocidal imperative to murder all Jews via kid-friendly television programs featuring oversized talking animals. Nassur the Bear explains to young viewers of Hamas' Al Aqsa TV on Sept. 22, 2009, “There won't be any Jews or Zionists, if Allah wills. They'll be erased. . . . We want to slaughter (Nidbah-hom) them, so they will be expelled from our land, right? . . .And if they don't want [to go] peacefully, by words or talking, we’ll have to [do it] by slaughter.â€

The government is determined to protect high-ranking Israeli officials from arrest in the UK, the attorney general said, as it emerged that a further visit by the Israeli military had been cancelled.


Speaking at the Hebrew University of Jerusalem today, Baroness Scotland said Israeli leaders should not face arrest for war crimes under the law of "universal jurisdiction", following attempts by British lawyers last month to obtain a warrant for the former Israeli foreign minister Tzipi Livni.

"The government is looking urgently at ways in which the UK system might be changed to avoid this situation arising again," Scotland said. "Israel's leaders should always be able to travel freely to the UK."

Scotland's assurance comes as the Guardian learned that the Israeli military had cancelled a visit by a team of its officers to Britain after fears they risked arrest on possible war crimes charges.

A group of officers, reportedly from the rank of major up to colonel, were invited by the British army for a meeting on military co-operation but cancelled last week. There were also reports today that Israeli officials feared possible arrest warrants and contacted British authorities to demand a guarantee that the officers would not be arrested.

Last week, British officials reportedly said they could offer no such guarantee and the Israeli military promptly cancelled the visit. The Israeli military, also referred to as the Israel Defence Force, declined to comment. News of the latest cancellation by high-profile Israeli politicians or army officers is likely to intensify debate around the ability of UK-based lawyers to obtain arrest warrants.

In October, Moshe Ya'alon, a former general and current cabinet minister, turned down an invitation to visit London for fear of arrest over an Israeli air strike in Gaza dating back to 2002. Two weeks earlier, lawyers also tried to secure an arrest warrant against Ehud Barak, Israel's defence minister, while he was visiting Britain. They did not succeed since as a serving minister Barak still has diplomatic immunity.

Israeli leaders have grown increasingly frustrated about the threat of legal action against individuals and said they would be pressing Scotland to change UK law in meetings today in Jerusalem.

"The risk to senior Israeli figures does concrete and immediate damage to bilateral relations", said the deputy foreign minister, Danny Ayalon, today.

"Organisations that are hostile to Israel try to exploit the legal channels and legal tools to threaten the Israeli and British decision-makers, including the authorities of the attorney general herself, and to thereby create political facts that should be determined around the diplomatic negotiating table."The UK is one of a number of countries where private prosecutions can be brought for alleged war crimes committed abroad. Following the attempt to obtain an arrest warrant for Livni from a London magistrates' court last month, the Guardian reported Foreign Office plans to change the legal process so that the attorney general would first approve warrants before suspected war criminals could be arrested. The "safeguards" were to apply to all visiting foreign leaders, not just Israelis, but provoked outrage from lawyers.

"If there is evidence against Israeli leaders and a judge thinks that there is a case to answer, then why does the process need to be changed?", said Daniel Machover, a partner at Hickman & Rose, whose firm obtained an arrest warrant in 2005 for the Israeli general, Doron Almog.

"In my view, it is not constitutionally proper to give the attorney general involvment at the arrest stage. We would not have a politician standing next to a policeman who decides whether or not to arrest someone, why should we have a politician standing next to a judge?"

Gaza flooded after Israel opens dam gates

Israel has opened the floodgates of one of its dams in the eastern part of the Gaza Strip, flooding Palestinian houses and causing severe damage.

The Israeli authorities opened the dam's floodgates without any prior warning or coordination with local authorities in Gaza, stunning the residents of the area, the Press TV correspondent in Gaza reported late on Monday.

There has been heavy rain in the region over the past 24 hours. It seems the Israeli authorities could not handle the huge amount of rainwater and decided to open the floodgates without prior warning.

Because Gaza is located in a low-lying area and the elevation decreases on the way to the Mediterranean Sea, water gushed into the area, flooding two Palestinian villages and displacing a hundred Gazan families.

The locals say Israel intentionally caused the floods, the Press TV correspondent said.

The waters from the dam, called the Valley of Gaza, flooded houses in Johr al-Deek village, which is southeast of Gaza City, and Nusirat in the eastern part of the territory, where the Al-Nusirat refugee camp is also located.

The Valley of Gaza is about 8 kilometers long. It starts on the eastern Gaza border with Israel and ends in the Mediterranean.

The houses of many Palestinians have been flooded and a number of people are trapped inside or on their roofs, while many have also gone missing, the Press TV correspondent said.

Rescue teams are using small boats to evacuate the trapped people.

Hamas has condemned the act as a war crime and has called on all concerned parties to intervene and offer assistance to the locals.

The flooding has made life more difficult for the Gazans, especially for those still living in tents because their homes were destroyed in the December 2008-January 2009 Israeli war on the Gaza Strip.

In the war, more than 1,400 people were killed, mostly women and children, and over 10,000 houses were destroyed or damaged, forcing at least 500 families to live in tents.

Very little progress is seen in reconstruction of the devastated areas in the Gaza Strip, mostly due to the Israeli blockade, which has prevented the delivery of building materials to the coastal enclave.

Interestingly enough, israel is having the same problem. The Judicial branch is at odds with the executive branch. Seems that the judicial branch doesn't approve of some actions of the ex.

Palestinian graves found damaged after settlers visit

Damaged graves and racist graffiti have been found in the Palestinian village of Awarta in the northern West Bank after a Jewish group visited the area.

Palestinians said they had seen Jewish pilgrims, escorted by Israeli soldiers, in the area, which is also a Jewish burial site.

The Israeli military said it viewed the incident very seriously and was opening a military police investigation.

It comes a month after an arson attack on a mosque in the same area.

At least two tombstones were damaged in the cemetery outside the village, and food and rubbish were left on graves.

In the village, offensive slogans about Arabs were found scrawled in Hebrew, English and Russian.

Israelis are forbidden from entering Awarta, but the Israeli military occasionally organises group trips for settlers to visit nearby Jewish tombs.

Palestinians told the Israeli rights group B'tselem that such a visit had taken place on Tuesday night, and the damage was discovered on Wednesday morning.

B'tselem said the tombs may have been ones that had been previously broken and repaired.

Local media quoted a group that organises visits by settlers to Jewish tombs as saying "we have no right wing or anti-Arab ideology and if someone from our group is found responsible for these acts, we would be the first to condemn them".

This comes two days after 10 Jewish settlers from the nearby settlement of Yitzhar were arrested in a pre-dawn raid.

Police said they wanted to see if there was a link between the individuals and the burning of a mosque in the village of Yasuf in December.

Offensive slogans were daubed on the mosque wall in Hebrew.

Some hard-line settlers have said they will attack Palestinians in retaliation for any Israeli government measures they see as threatening Jewish settlements.

The Israeli Prime Minister Benjamin Netanyahu recently announced a ten-month lull in permits for new settlement homes on the West Bank, not including East Jerusalem.

All Jewish settlements in the West Bank, occupied by Israel in 1967, are illegal under international law, although Israel disputes this.
