What's happening with that Lawsuit against Pershing County?
What's happening with that Lawsuit against Pershing County?
Just out of curiosity, what's happening with that lawsuit against Pershing County? What is the next step, and when is it happening?
It's kind of amazing to me how slow these things move...

My experience with the USA legal system is basically non-existent - I do know that law-suits take time, lots of time. There is a website http://brcvpc.com/ which has (as far as I am aware) all the available info.
Hope that helps your curiosity...

Sadly it doesn't appear to have been updated since August, and there were things that happened in October according to Google (Pershing failed to dismiss). If it had been kept up to date that would have been a really useful website! Oh well....

yes, updates would be useful in knowing what is happening! Unfortunately, that is not the case {sigh}.

Re: What's happening with that Lawsuit against Pershing Coun
There were a string of posts about it in the 'Nudity Banned This Year?' thread that was started prior to the 2012 event. Nothing's really happening with it at the moment, and I don't think there are any court dates scheduled before the 2013 event. Relevant updates would be posted on the Burning Blog as well as covered in the Jack Rabbit Speaks newsletter.

FYI...
Nevada Assemblyman David Bobzien who represents Reno filed draft legislation that would "prohibit local governments from enacting ordinances that restrict events such as Burning Man on federal lands."

Re: What's happening with that Lawsuit against Pershing Coun
Looks like good news to me!
http://www.ktvn.com/story/21936281/neva ... g-man-bill
A Nevada legislative panel has narrowly approved a bill to prevent rural Pershing County from imposing its own rules and fees on the Burning Man festival held annually on the Black Rock Desert.
AB374 now goes the Assembly floor.
It follows a lawsuit filed last fall by Burning Man organizers challenging a county festival ordinance that seeks to impose a $1.50-per-head fee to cover law enforcement costs. Organizers say the ordinance also seeks to regulate behavior at the counter-culture festival that draws more than 50,000 people to the desert 110 miles north of Reno.
The bill before the Legislature prevents a board of county commissioners from regulating or licensing an event if a federal agency has issued a license or permit.
Burning Man receives a permit from the BLM.

Thought I'd post a link for all you fine burner types to peruse:

The story is from last Thursday. One 'error' - we have no "looky-loos" at Burningman. Only participants. But that's my opinion, too.

Now, this Mr. Shirley seems a bit inconsistent, but...
...did he not just propose a splendid solution to the situation?

“We’re taking a hard look. We’re not paying for this,” Pershing County Dist. Atty. Jim Shirley told the Los Angeles Times. “We’ll hand the whole thing over to the Bureau of Land Management, if that’s what they want.”

Yes, indeed! But I don't think they'll do it. What gripes their guts is the thought of all that money up there in the corner of their desolate county, over the hills and far away...

Why should we pay more money for more cops to come to our party. We didn't invite them anyway.

Nevada bill bars county fees on Burning Man festival
The Burning Man Festival continues to enjoy success in its quest for legislative protection from county fees and oversight.
The Nevada Assembly passed AB374 in a 26-15 party line vote Tuesday.
Democratic Assemblyman David Bobzien of Reno is sponsoring the bill that prohibits a board of county commissioners from imposing fees or regulations on festivals operating under a federal license or permit. The popular counterculture festival happens 110 miles north of Reno in the Black Rock Desert.
Opponents of the bill sought amendments to remove the country from liability and responsibility of prosecuting crimes due to the high costs of law enforcement for about 50,000 people.
Republican Assemblyman Ira Hansen of Sparks says the bill undermines county authority and makes funding law enforcement difficult for counties.

Re: What's happening with that Lawsuit against Pershing Coun
From what I recall, Pershing County imposed a huge arbitrary fee last year, which was paid under duress by BMorg. It would seem that the money that was paid should be coming back in the org now. If that's the case, Pershing County is not going to be happy AT ALL!

This bill was originated by two of our cow counties legislators. The original intent was to keep counties from imposing extra fees to ranchers who have BLM permits for grazing.
After the bill was amended to include events, festivals the 2 original legislators switched sides
go figure...

420, you mean that this bill was not intended to benefit festivals and the money they bring into the Northern Nevada communities, yet it still seems to be moving through the legislature? I don't get it. Could it be a prearranged plan to stall the fight against the money/power grab and then shoot it down at the last minute? Burning Man is largely above board with not many dirty palms grabbing the pie. That will provide a challenge to for Nevada to embrace Burning Man like they embraced the sin of Las Vegas. It will be interesting to see where this ends up.

no I'mjust saying it started out as a bill to keep counties from over taxing/fees on ranchers who get a federal permit from the blm to graze cows.
Burning man gets a federal permit from blm to graze people
Counties such as washoe, lyon and clark see the benefits of bm on our local economy. pershing county not so much...
Im not sure i understand your conspiracy theory

From the LA Times article
Was Paul Addis' trial in Pershing or Washoe county courts? It's the biggest one I can think of.
A solution, he (prosecutor Shirley) suggested, would be to make festival-goers exempt from all laws.
"This would ensure that whatever happens, small rural counties will not have to bear the burden of prosecuting state criminal violations which occur as a direct and proximate result of the large outdoor assembly occurring within a particular county," he wrote to lawmakers.

It appears that a search says it was prosecuted in Pershing County. I may be wrong.
