BRC police scanner live feed needs AM or FM transmitter

Post by antechrist » Thu Jul 18, 2013 8:31 am

As a service to the participants of BurningMan 2013, I'd like to set up an AM or FM radio broadcast of localized police radio transmissions. I have a police scanner and reciever antennas, but no transmitter. The original idea was to put a feed up on the internet, but I've since been told no one has internet coverage on the playa so they wouldn't be able to listen in that way. AM/FM radio would provide a more accessible service to the playa. I know its a long shot, but anyone who has a transmitter and would like to help out with this, please contact me.

Just a hunch... that this would be illegal and would soon be shut down, possibly involving penalties. And pretty sure I read on this board that your scheme has already been tried -- complete with the subsequent forced shutdown.

Well, at least in the back of your RV.

I don't know about Nevada, but the reason you get tickets for police scanners in CO is that the state claims that listening to police transmissions is an invasion of suspect and/or victim privacy.

Hello Mr antichrist (don't get to say that very often),

You think you are providing a gift to Burning Man participants, but you could be doing the complete opposite. Everything every participant does to/from and at the event should be focused on creating the best possible relationship with each individual LEO and with their management. You pissing them off simply and directly falls on other participants and on the organizers. Remember they have their own stresses like any burner at the event which you could be adding to with your project.

Voyeurism for the masses does not create enough pleasure to compensate for the pain which is created for individuals, in my opinion.

Send an email to legal (at) burningman.com to get a reading on your idea. They can get a reading from LEAL, the people that work with all the agencies that are on playa. Hey, you can ask them if they want all the internal BM department radios broadcast too!

Have a great burn!

My friend who broadcasted the scanner activity still has those recorded into mp3s. I'm sure it won't compromise life and limb to play police radio activity from yesteryear. Anybody who wants to listen to LEA activity can simply buy a scanner. It's not classified information. It's just that the cops feel comfortable knowing that hardly anybody listens to a radio made specifically for such purposes.

That's what you'd think, but if memory serves (not my memory of the events, but memory of the story, I was too young) at some point in the 80's an "Open Book Policy" was put into place for State/County/City Police, which made it illegal to tell people they're not allowed to listen to police radio. So, then the loop hole is they made it an invasion of privacy because someones full name could be used over the radio. I wouldn't be surprised if someone who was a victim wound up in the news paper because a reporter was listening to a Police scanner.

Maybe you know a thing or two but you don't know much about radio... It's legal to listen, but rebroadcasting it is definitely illegal!!
That's where your trouble is. If you piss them off, they can definitely get you on that, it's an FCC thing.

Well that and it's a stupid idea anyway.

Can't wait to see you posting in one of those "I got busted at the burn" threads later!

thats probably why sending it on the internet has been largely OK. (judging by the proliferation of it on the net)

Exactly. Most of the FCC rules were written in 1934, the Internet is exempt from just about all rules about broadcasting.

it looks like the FCC doesnt even know if its illegal.

"A more recent Supreme Court decision, however, questions the ability of the government to regulate the disclosure of legally obtained radio communications, and this area of the law remains unsettled."

http://transition.fcc.gov/cgb/consumerf ... eption.pdf

in relation to this case:

http://en.wikipedia.org/wiki/Bartnicki_v._Vopper

its certainly not explicitly illegal (federally) ... perhaps more of a gray area ;-)

i dont see much of any point in doing this for consumption at the event..BMIR is surely better entertainment.

i liked the idea much better when it was for people..not at the event.. over the internet (not that i feel sharing this at the event endangers anyone or hampers the ability of anyone to do their job in any way.. i dont)

if ya wanta listen to this stuff at the event.. you can just bring a police scanner (that is.. if you can even pick up the transmissions at all)

it seems like, whether its legal or not, playing it over AM or FM will just be poking the hornets nest of the folks who will want to shut ya down because they feel its the right thing to do (see posts above about 'interfering with an officer while blahblahbalh) ..if joe shmoes on the internet can think of up some reason for you to not do this..(whether it aligns with the law or not) you can bet one of the hundreds of law enforcement people... and well meaning rangers and LLC people with radios on their hips.. will find a reason as well.

all the legal wonks checking in, lol

there are sites broadcasting police scanners all over the internet

but an FM/AM broadcast is much different?

since leos already work in a transparent environment regarding scanners, i don't see the big rub

but then, i'm not a lawyer. lol

Yes, broadcasting on the Internet and on radio are one million percent different!!
As far apart legally as can be.

But hell do what you want I don't care. I'll be listening to music or occasionally BMIR. Or just the sounds of the playa.
I don't give a shit about the cops because I won't be doing anything uncool.

No, the police support squad is always welcome at my camp. I don't think Elliot tried to give any legal advice. So why are you not playing nicely? I respect Elliot's wisdom and candor - and his mechanical knowledge makes him hawt.

some public safety agencies broadcast their own stuff

they must not be worried about being obstructed

the erratic hive mind of eplaya never fails to deliver

always anticipating cause and effect leveraging barely tangential data points

that dusty white noise in binary

filter through and there is abundant knowledge
