Tree Hugger uses a Burning Man photograph

Post by phil » Wed Aug 08, 2007 11:28 am

No credit is given, and it's apparently altered, for the photo used to illustrate an article on recycling plastics.

Anybody know where this shot came from?

Okay, let me put my lawyer hat on..hmmmm looks like a guy on a bicycle, a digitized rendering of Ehron from Boulder's project for this year's playa, a mountain, and a vast tract of public land! Yep, not seeing the problem.

You should talk to the folks building the glacier. The image is from their web site.

for those of you in the Boulder-Denver area, Ehron really needs some more volunteers to help build the Black Rock Glacier.

Contact him at 512 577-3136 if you're in the area and want to pitch in.

They either added it or it was overlooked.

Once again:
The photographer holds the copyright on that photograph. There are no identifiable people in the photograph. The org cannot dictate what a photographer can do with their copyrighted photograph.

Many don't know this, but BMorg holds the copyright to every photo taken in or around a desert environment

A lot of people don’t believe the BMorg has a legal or moral right to claim copyright on the artistic expression of others.

I think it would have to be a case by case issue, what battles are worth fighting and what kind of imagery are infringements.

BRC LLC does not hold the copyright on every image taken out there- they require the media to get permission before using images they take. Images taken for personal use (other than selling) they don't really care about. It's only when it comes down to money that they jump in.

Could you challenge them in court? Sure. Could you win? Not so sure. "Girls Gone Wild" lost, and they probably have more money than you.

The LLC does hold the copyright (at least for now) on the image of The Man, the street signs, the BRC name, city layout.........

That being said, use your images as you want. Unless you're trying to sell 1,000 posters on eBay you're probably fine.

Actually BMorg holds the copyright to any photo, film, drawing, decoupage or other pictoral representation of any of the following:

desert, dust, topless women, ravers, glowsticks, DJs, bicycles, water trucks, porta potties, decapitated Barbie Dolls, pople in ridiculous costumes.

correct. Unfortunately my humor is drier than playa dust and needs 'splainin' from time to time.

I hope everyone has safe travels to and from the Playa! See ya at the meet-n-greet!

Normally I would have picked up on that. Lets just say it hasn't been the best week, and leave it there. My humor sensors are a bit awry right now.
